Enforcing Removal Orders When a Person is Confirmed to be Outside of Canada

Description of the objective

Inadmissible persons may be issued a removal order. If an individual fails to confirm departure with the Canada Border Services Agency (CBSA), the removal order may remain unenforced. Currently, a removal order can only be enforced by an officer outside of Canada in very limited circumstances. Regulatory amendments to the Immigration and Refugee Protection Regulations are being considered to expand officer authority to enforce a removal order where the person concerned is confirmed to be outside of Canada.

Public consultation opportunities

Initial public consultations on the proposed regulatory amendments were undertaken in summer 2017 via an online consultation that was posted on the CBSA and Consulting with Canadians websites. Various key stakeholders were notified and invited to provide comments, including:

In addition, the proposed regulations were pre-published in Part I of the Canada Gazette on May 19, 2018. The public was given a 30-day period to provide comments on the proposed amendments. No comments were received.
